The Supreme Court is considering four separate questions to determine the constitutionality of the Patient Protection and Affordable Care Act of 2010:

  1. Is suit permitted by the Anti-Injunction Act? The 11th Circuit held that suit was not barred by the AIA.
    A vote to AFFIRM means that YES, the suit can proceed notwithstanding the AIA. A vote to REVERSE means that the AIA bars the suit. Predict here.
  2. Is the mandate unconstitutional? The 11th Circuit held that the mandate exceeded Congress’s powers and is unconstitutional.
    A vote to AFFIRM means that YES, the mandate is unconstitutional. A vote to REVERSE means that mandate is constitutional. Predict here.
  3. Is the mandate severable? The 11th Circuit held that even though the mandate was unconstitutional, it was severable, and upheld the remainder of PPACA.
    A vote to AFFIRM means that YES, the mandate is severable. A vote to REVERSE means that the mandate is not severable. Predict here.
  4. Is the Medicaid expansion constitutional? The 11th Circuit held that PPACA’s expansion of medicaid was constitutional.
    A vote to AFFIRM the 11th Circuit means that YES, the Medicaid expansion is constitutional. A vote to REVERSE means that the Medicaid expansion is unconstitutional. Predict here.
